Terms of Service

The Short Version

You pay monthly and can cancel anytime. Nothing gets posted without your approval. You hold the logins and own the accounts — we create the content, you stay in control. Cancel within 7 days of your first payment, before we've started any work — including creating your accounts — and you get a full refund. We can't guarantee recruitment, scholarships, or NIL deals — nobody can. If a social media platform removes or restricts an account, that's the platform's decision and not something we're liable for. For athletes under 18, the parent or guardian is the client and gives consent.

The full terms below are what legally applies — the summary is just to make them easy to understand.

1. Who we are and agreement to these terms

Edge Elite Sports ("we," "us") provides social media content creation and profile setup services for student-athletes, and may assist with account management at the client's direction. By purchasing a subscription, checking the agreement box during onboarding, or using our services, you ("you," "the client") acknowledge that you have read, understood, and agree to be bound by these Terms of Service, which form a binding agreement between you and us. If you do not agree, do not purchase or use our services.

2. The services

We create content and help set up and build social media profiles for student-athletes according to the package you purchase. The client (or parent/guardian) holds the account logins and owns the accounts at all times. Any account access we use is granted by you, at your direction, and may be revoked by you at any time. Package contents are described on our website at the time of purchase. We are a content creation and profile setup service.

3. Eligibility and parental consent

The purchasing client must be at least 18 years old. Where the featured athlete is under 18, the purchasing client confirms that they are the athlete's parent or legal guardian and consents to our use of the athlete's name, image, statistics, school affiliation, and information they provide to us for the purpose of creating and publishing the content they purchased. We will not feature an athlete in our own marketing (such as Athlete of the Month) without separate, written consent.

4. Account ownership and access

Social media accounts are created in the athlete's name and owned by you. You hold the login credentials at all times; we do not retain exclusive control of any account. We recommend you enable two-factor authentication tied to your own phone number and keep ownership of all passwords. You may revoke our access at any time, and you own all content we create for you.

5. Approval policy

We do not post, message, or otherwise publish anything without your direct approval. Approval must be given in writing (for example, by text or email reply confirming a specific piece of content). We may rely on any written approval you provide, and we are not responsible for content you approved. Timely approvals are your responsibility; if you do not respond to a content approval request, we will not publish that content, and any resulting delay in delivery is not our responsibility.

6. Account access and credentials

Where we assist with posting or account setup, you grant us limited access at your direction, and you remain the owner and primary holder of all login credentials. We will not change passwords, recovery information, or account ownership settings without your consent. You are responsible for safeguarding your credentials, and we are not liable for actions taken on your accounts using access you have granted, or for platform decisions (including suspensions or bans) outside our control.

7. Payments and billing

Subscriptions are billed in advance on a recurring basis through PayPal at the prices listed on our website at the time of purchase. We may change prices with notice; changes take effect at your next billing cycle.

8. Cancellation

You may cancel at any time through your PayPal account or by contacting us at edgeelitesports@gmail.com. Cancellation takes effect at the end of your current billing period. You keep your accounts and all content already delivered.

9. Refunds

If you cancel within 7 days of your first payment and we have not yet begun any work — including creating or setting up any accounts, building any profile, or producing any content — we will refund that payment in full. Once we have started any of that work, the full-refund window closes. Otherwise, payments for billing periods already started are non-refundable. If you pay but do not submit your intake form, your subscription remains active until you cancel; we encourage you to complete the intake or cancel promptly.

10. No guarantee of outcomes

We do not guarantee — and nothing we publish or say should be read as guaranteeing — recruitment, roster spots, scholarship offers, coach responses, follower counts, engagement, or NIL deals. No one can guarantee these outcomes, and you should be cautious of anyone who does.

11. Compliance and independence

We are not athlete agents and we do not negotiate NIL deals. We are not affiliated with, endorsed by, or acting on behalf of the NCAA, NAIA, NFHS, or any state athletic association. Eligibility and NIL rules vary by state and school; you are responsible for confirming that participation in our services complies with your athlete's school, state association, and any applicable collegiate rules.

12. Your responsibilities — what we need from you

Our work depends on your participation. By using our services, you agree to the following:

Respond promptly. Because nothing is posted without your approval, you agree to review and approve (or decline) content in a timely manner. Delays in your response may delay delivery and are not our responsibility.

Provide photos and video. You agree to capture and send us photos and video of the athlete — at games, practices, training, and key moments — so we have real material to build content from. The quality and consistency of your content depends in large part on what you send us. We are not responsible for limited or delayed content caused by a lack of usable material from you.

Send materials to us. You agree to send those photos, videos, and any other materials to us through the method we provide. You confirm you have the right to share everything you send and that it does not violate anyone else's rights.

Provide accurate information. You agree to give us accurate details, stats, and information, and you are responsible for the accuracy of any statistics or claims you ask us to publish. We will not exaggerate or fabricate stats.

For athletes under 18. As the parent or legal guardian, you are responsible for consenting to and overseeing the athlete's participation, and for confirming that participation complies with the athlete's school, state association, and any applicable collegiate rules.

13. Platform actions and account availability

Social media platforms (including but not limited to Instagram, X, TikTok, Facebook, and others) are independent third parties with their own terms, policies, and enforcement. We do not control these platforms and cannot guarantee that an account will remain active, visible, or unrestricted. We are not liable if a platform suspends, restricts, shadow-bans, deletes, disables, or removes an account or any content — whether on a managed account, an account we helped set up, or content we created — for any reason, including alleged violations of the platform's rules, automated enforcement, errors, or changes in platform policy. You are responsible for reviewing and following each platform's terms of service. Any losses arising from a platform's action are not the responsibility of Edge Elite Sports.

14. Your indemnification of us

You agree to defend, indemnify, and hold harmless Edge Elite Sports and its owner from and against any claims, damages, losses, liabilities, and reasonable costs (including attorney's fees) arising out of or related to: (a) photos, video, statistics, statements, or other materials you provide or ask us to publish; (b) your breach of these terms; (c) your violation of any law or of any platform, school, state association, or collegiate rule; or (d) any claim that materials you supplied infringe a third party's rights. In short, if something you provided or directed causes a claim against us, you are responsible for covering it.

15. How we handle your information

We collect the information you provide (such as the athlete's name, stats, photos, school, and contact details) only to deliver the services you purchased. We do not sell your information, and we do not share it except as needed to provide the services (for example, publishing approved content to the athlete's own accounts) or as required by law. We take reasonable steps to keep your information secure. You may ask us to delete the personal information we hold about you at any time by emailing edgeelitesports@gmail.com, and we will do so unless we are required to keep it. Because our services involve minors, we are especially careful with this information and only use it for the purpose you engaged us for.

16. Use of work in our portfolio

We will not feature your athlete in our own marketing, examples, or portfolio (such as an "Athlete of the Month" or "our work" showcase) without your separate, written consent. If you grant that consent, you may withdraw it at any time by emailing us, and we will stop using the material going forward.

17. Limitation of liability

Our services are provided "as is" and "as available," without warranties of any kind, express or implied, except those that cannot be disclaimed under applicable law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost opportunities, lost recruitment or scholarship outcomes, lost followers, or lost profits, even if we were advised such damages were possible. To the maximum extent permitted by law, our total cumulative liability for any and all claims arising out of these terms or the services is limited to the greater of (a) the total amount you paid us in the three months before the claim arose, or (b) one hundred dollars ($100). Nothing in these terms limits liability that cannot be limited by law.

18. Termination by us

We may decline or end service for abusive conduct, unlawful use, or requests that would violate platform rules or these terms. If we terminate without cause, we will refund the unused portion of your current billing period.

19. Disputes

If a dispute arises, you agree to first contact us and attempt to resolve it informally. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Michigan, and you agree to that venue. These terms are governed by the laws of the State of Michigan.

20. General terms

Severability. If any provision of these terms is found unenforceable, the rest remain in full effect, and the unenforceable provision will be applied to the maximum extent permitted by law. Entire agreement. These terms, together with the package details shown at purchase and any agreement you accept during onboarding, are the entire agreement between us and replace any prior understandings. No waiver. If we do not enforce a provision on one occasion, that is not a waiver of our right to enforce it later. Assignment. You may not transfer your rights under these terms without our consent; we may assign these terms to a successor (for example, if the business is reorganized as an LLC or sold). Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including platform outages, acts of God, or interruptions of third-party services.
